One of our core services is the registration of trademarks in Myanmar. While there is currently no trade marks law nor a formal system of trademark registration in Myanmar, a person may nonetheless protect his trademarks in Myanmar by registering a Declaration of Ownership of Trademark with the Office of the Registrar of Deeds in Yangon, pursuant to the Governmental Direction.
The documents required for the registration of a Declaration of Ownership of Trademark are a Power of Attorney form (Attachment A) and a Declaration of Ownership form (Attachment B).
The Power of Attorney must be notarized as well as legalised by the Myanmar diplomatic office in the applicant's home country, but the Declaration of Ownership of Trademark needs only be notarized. A specimen of the subject mark must be affixed to the Declaration of Ownership. Both the Power of Attorney and the Declaration of Ownership must be executed by the owner of the trademark or its authorised representative and submitted to the Registrar within 4 months from their respective dates of execution. The registration process will take approximately two weeks.
After the Declaration of Ownership is registered, the owner of the trademark may wish to publish a Cautionary Notice in the local English newspapers. This notice would contain the particulars of the trademark, the name of the owner as well as a short warning against infringement of the trademark. Although it is not compulsory to advertise, it is advisable and customary to do so as it is essentially the only means by which the public may be made aware of the applicant's proprietorship of the mark.
We also wish to clarify that other than the registration of a Declaration of Ownership of Trademark, there are no provisions in the laws of Myanmar for the protection of other Intellectual Property rights, such as industrial design and patent. In the case of copyright, this would be protected under the Copyright Act by way of civil litigation against an
infringer.
